1. INTERPRETATION
1.1 In these conditions,

'CONDITIONS' means the standard terms and conditions of sale set out in this document and (unless the context otherwise requires) including any special terms and conditions agreed in writing between you and Nautical Napkins
`CONTRACT' means the contract for the purchase and sale of the napkins.
`WRITING' includes electronic mail and letter.

2. CONSUMER PROTECTION (DISTANCE SELLING) REGULATIONS 2000
2.1 Under the distance selling regulations you are entitled to cancel the contract with Nautical Napkins up to 7 business days from the date after receipt of the goods. However, because Nautical Napkins are providing a bespoke service you may not cancel just because you change your mind. Nautical Napkins will, of course, provide you with a full and complete refund should the napkins be faulty in any way. You are under a duty to return the napkins to Nautical Napkins and in the mean time take reasonable care of them. You must pay for the safe return of the napkins to the Nautical Napkins and, where you do not return the goods, then you must pay Nautical Napkins all reasonable charges to recover them.
Nautical Napkins may deduct the cost of collecting the goods from any refund if you fail to return the goods.
The contract may only be cancelled in writing, either by fax or email, a telephone call is not enough.
Where a consumer exercises the right to cancel under the cooling off period, the goods should be returned or be available for collection with 5 days of the notice being given.
Where Nautical Napkins has despatched napkins to you but the napkins are not delivered (due to you either refusing to accept or not be available to take delivery) then Nautical Napkins shall refund the cost of the goods minus any reasonable charges in recovering the goods.

3. ORDERS AND SPECIFICATIONS
3.1 No order submitted by you shall be deemed to be accepted by Nautical Napkins unless payment has been taken by Nautical Napkins.
3.2 The quantity, quality and description of and any specification for the napkins shall be those set out in Nautical Napkins's quotation via the web site (if accepted by you) or your order (if accepted by Nautical Napkins).
3.3 Any amendments or cancellations to orders must be received in writing by either letter or email. If no written confirmation is received then no changes will be made to the order and goods will be delivered as per the order.

4. PRICE OF GOODS
4.1 The price of the goods shall be Nautical Napkin's quoted price on the website. Buyers shall make an offer to purchase the goods from Nautical Napkins by placing an order on the website. This offer to purchase does not constitute Nautical Napkin's acceptance to supply the goods at the price shown. The contract shall be made at the point where Nautical Napkins takes a payment from you in total. Nautical Napkins will notify you within 48 hours if the offer to purchase is not accepted.
4.2 Except as otherwise stated under the terms of any quotation or in any price list of Nautical Napkins, and unless otherwise agreed in writing between you and Nautical Napkins, all prices are given by Nautical Napkins on an ex works basis, and where Nautical Napkins agrees to deliver the goods otherwise than at Nautical Napkin's premises, you shall be liable to pay Nautical Napkin's charges for the transport and packaging as detailed on the website .

5. TERMS OF PAYMENT
5.1 Nautical Napkins shall not be bound to deliver the Goods until you have paid for them. Payment shall be due before the delivery date and time for payment shall be of the essence.

6. ACCEPTANCE OF THE GOODS
6.1 you is deemed to have accepted the Goods once a reasonable period has elapsed from date of delivery.
6.2 If the goods are thought to be defective after a reasonable period has elapsed then a replacement or repair may be offered if the napkins are indeed found to be defective.

7. DELIVERY
7.1 Nautical Napkins shall make delivery of the Goods to you as agreed by Nautical Napkins.
7.2 Any dates quoted for delivery of the napkins are approximate only and Nautical Napkins shall not be liable for any delay in delivery of the napkins however caused. Time for delivery shall not be of the essence of the Contract unless previously agreed by Nautical Napkins in writing.
7.3 Nautical Napkins may elect to deliver multiple orders on different days by different couriers. Nautical Napkins in the interests of convenience to you will keep these instances to a minimum.
7.4 The Goods shall be delivered to you at your address. The risk on the Goods shall pass to you upon such delivery taking place.

8.8 All orders from this website are processed and fulfilled by eBIZZ Ltd, acting as agent for Jake Lunn .

9. LEGAL JURISDICTION
9.1 This agreement is made under English law, and both parties submit to the jurisdiction of the English courts.
